Life Sentence for Gang Rape in Mpumalanga
A 26-year-old man from Mpumalanga, Sifiso Ronny Prince Mokoena, received a life sentence in the Belfast Magistrate’s Court after the court convicted him of gang rape. Mokoena was found guilty of the crime that occurred on July 26, 2020. He initially pleaded not guilty to the charges.
The Attack and Investigation
Monica Nyuswa, the provincial spokesperson for the National Prosecuting Authority (NPA), confirmed the details of the attack. The victim, a 40-year-old woman, had been collecting firewood with two other women at Waterval Boven, near Belfast. Three men, wearing balaclavas, approached them. Two of the men threatened the victim and took turns raping her before fleeing the scene.
The victim immediately reported the attack to the authorities. Police then launched an investigation and arrested Mokoena after DNA evidence linked him to the crime. Authorities have yet to find his co-perpetrator.
Court Proceedings and Evidence
During the trial, Mokoena chose to remain silent after initially pleading not guilty. State Prosecutor Makhosonke Mashinini presented compelling evidence to the court. This evidence included testimony from the victim and two women who witnessed the attack. Additionally, the court received DNA evidence, a J88 medical report, and a photo album depicting the crime scene.
Arguments for Sentencing
In his arguments for sentencing, Mashinini emphasized that Mokoena had shown no remorse for his actions. Mashinini argued that the convicted man was not a candidate for rehabilitation. Furthermore, Mashinini stated that a severe sentence was necessary to deter others and deliver retribution.
Victim Impact Report
The court also considered a victim impact report. This report detailed the emotional, physical, and psychological trauma the victim had suffered. Despite the defense’s arguments, the court found no substantial reasons to deviate from the mandatory life sentence for gang rape.
Additional Legal Consequences
The court also declared Mokoena unfit to possess a firearm and unsuitable to work with children. Nyuswa, speaking on behalf of the NPA, emphasized that this conviction reinforced the organization’s dedication to protecting vulnerable members of the community.
Strong Message from the Justice System
The Acting Director of Public Prosecutions, Sonja Ntuli, praised the sentence. She asserted that it would send a strong message to potential offenders. Ntuli also stressed that the justice system remains committed to addressing such crimes and protecting public safety.
