Court Hands Down Life Sentences

The Lenyenye Regional Court in Limpopo has sentenced Refilwe Solly Malatjie, 23, and Hlupi Linda Mathiba, 25, to life imprisonment for the murder of Thabang Theosel Mafogo.

Details of the Murder

The National Prosecuting Authority (NPA) reported that Malatjie and Mathiba killed Mafogo on December 26, 2019, following a violent altercation. Despite their not guilty pleas, the court convicted both men based on testimony from witnesses. These witnesses described the brutal attack.

The NPA explained that the confrontation began at a tavern during the early morning hours. “Accused one (Malatjie) argued with the deceased, Thabang Theosel Mafogo,” the NPA stated. “The two accused men then confronted Mafogo. They assaulted him with open hands and booted feet and threw stones at him. When Mafogo tried to escape, they chased him down. They caught up with him eventually.”

The Brutality of the Attack

The court learned that Malatjie held Mafogo while Mathiba stabbed him three times in the chest. Mafogo died at the scene.

The NPA emphasized that Mafogo was unarmed during the attack. Furthermore, they highlighted that there appeared to be no justifiable reason for the murder. The court agreed and found no substantial or compelling reasons to reduce the mandatory life sentence.

Impact of the Sentence

Advocate Ivy Thenga, the Director of Public Prosecutions in Limpopo, expressed hope that the sentence would deter others from committing similar crimes. “We hope this judgment will prevent young men and women from committing violent acts,” Thenga said. She also praised the lead prosecutor, Ledwaba, for her efforts throughout the trial.

The court’s ruling serves as a significant reminder of the consequences of violent crime. It sends a strong message to the public about the seriousness of such offenses.
