Eastern Cape rapist sentenced to 15 years after committing crime on parole

The repeat offender was arrested after committing rape while on parole.


A repeat offender, Bonginkosi Ngcingci, has been sentenced to 15 years for rape after committing the crime while on parole in Makhanda, Eastern Cape.

A repeat offender in the Eastern Cape has been sentenced to 15 years in prison for rape. This is in addition to serving the remainder of a previous sentence. Bonginkosi Ngcingci, 36, was on parole. This was after serving 10 years of a 15-year sentence for rape, robbery, and housebreaking when he committed another rape.

Luxolo Tyali, spokesperson for the National Prosecuting Authority’s Eastern Cape division, said Ngcingci was convicted of raping a 26-year-old woman. He claimed they had been in a relationship and that the encounter was consensual.

Ngcingci was sentenced in the Makhanda Regional Court.

Details of the crime emerge in court

Court evidence revealed that in the early hours of Dec. 23, 2023, Ngcingci followed the victim and her friend from a local hangout spot in Joza Location, Makhanda. An altercation broke out when he insisted on speaking with her despite her refusal. When her friend intervened, Ngcingci threw alcohol on the victim before disappearing.

When the woman arrived home, she found Ngcingci waiting on her bed with a knife. He grabbed her, threatened to kill her if she resisted, and raped her. Before leaving at about 5 a.m., he forced her to walk him out so it would appear he had stayed over by agreement. Once outside, the victim ran to her brother’s flat and reported the attack.

Arrest and trial proceedings

According to Tyali, her brother pursued Ngcingci, caught him, but he managed to escape. When the brother gave chase again, Ngcingci pulled out a knife, threatened to stab him, and fled. Later that day, he was arrested after his mother instructed him to surrender to police.

During the trial, the State presented testimony from the victim, her brother, and a friend who had been with her that night. Evidence included a photo album and the complainant’s J88 medical report.

Conviction and justice served

Ngcingci initially pleaded not guilty, insisting the sex was consensual. Under cross-examination by regional court prosecutor Khwezikazi Makonti, he changed his story, claiming the victim demanded money after sex. He said he could not pay and suspected she had stolen from him but could not explain why he never reported a theft.

Eastern Cape Director of Public Prosecutions Barry Madolo praised the prosecutor for securing justice and ensuring the removal of a violent criminal from the streets.
