Judge President Tribunal Delayed Over Gender Expert Testimony

The Judicial Conduct Tribunal investigating allegations of sexual harassment against Eastern Cape Judge President Selby Mbenenge has been postponed.

The delay followed the unavailability of some witnesses on Mbenenge’s legal team.

Andiswa Mengo, Mbenenge’s secretary, accused him of making unwelcome sexual advances in 2022.

The tribunal had scheduled a hearing on Tuesday, where gender violence expert Dr. Lisa Vetten was to testify.

However, following discussions in chambers, Tribunal Chairperson and retired Justice Bernard Ngoepe adjourned proceedings.

According to Ngoepe, the tribunal granted a postponement to allow Mbenenge’s team time to prepare adequately for Vetten’s testimony.

This came after Mbenenge’s counsel, Advocate Muzi Sikhakhane, objected to the testimony, claiming the summary of Vetten’s evidence was delivered too late.

Gender expert to testify despite legal objections

Despite the objection from Mbenenge’s legal team, the tribunal ruled in favor of allowing Dr. Vetten’s testimony.

Justice Ngoepe said the panel had carefully weighed the matter and emphasized the importance of caution in excluding potentially relevant evidence.

“Having considered the matter properly, we’re of the view that we should err on the side of caution and allow the evidence,” he said. “If it proves irrelevant, the panel will rule accordingly.”

The Judge President Selby Mbenenge tribunal is under close public scrutiny due to the nature of the allegations.

Dr. Vetten’s input as a gender-based violence expert is expected to provide critical context on power dynamics in the workplace.

Allegations cast shadow over judiciary leadership
