The trial of Thabo Bester and his co-accused has been postponed to July due to unresolved legal issues. Originally scheduled for February 10, 2025, in the High Court of Bloemfontein, the case will now begin on July 21, 2025. The delay stems from outstanding legal matters, including disputes over Bester’s detention conditions and the legal status of co-accused Dr. Nandipha Magudumana’s arrest.
Delays and Legal Challenges
Thabo Bester, the convicted serial rapist and murderer, faces 16 charges, including fraud, corruption, and violating dead bodies. Bester allegedly escaped from the Mangaung Correctional Centre in May 2022 with assistance from Magudumana and several prison officials. His defense team is demanding better detention conditions, including access to a laptop, preferred clothing, and specific foods during court appearances. The defense team made it clear that they will not proceed until these issues are resolved.
Magudumana’s Legal Battle
Magudumana, Bester’s co-accused and former partner, is waiting for a ruling from the Supreme Court of Appeal (SCA). She is contesting a High Court ruling that dismissed her application to have her 2023 arrest in Tanzania declared unlawful. Magudumana’s legal team argues that her arrest and subsequent extradition to South Africa were illegal. Her legal representative, Machini Motloung, voiced frustration over repeated delays, accusing the state of submitting additional documents late.
State’s Readiness to Proceed
Despite the defense’s motions, the state is ready to move forward with the trial. Free State Cape NPA spokesperson Mojalefa Senokoatsane emphasized that the delays are due to the defense’s actions. He assured the public that the state has gathered substantial evidence and remains committed to justice. Thabo’s case has generated significant public interest, and the prosecution is determined to proceed as soon as possible.
Accused Behind Bars
Thabo Bester, Nandipha Magudumana, and Zanda Boniface Moyo remain behind bars. Other co-accused, including Teboho Lipholo, Zolile Cornelius Sekeleni, Motenyane John Masukela, and Tieho France Makhotsa, are out on bail. All accused face multiple charges, including corruption, aiding an escape, and corpse mutilation. The trial for these charges will proceed once the remaining legal matters are settled.
Ongoing Legal Procedures
The Pretoria High Court previously struck Bester’s application for a laptop from the roll. The court ruled that Bester could access physical resources but not electronic equipment. Prosecutor Advocate Mosioa Mazibuko argued that the application abused court processes. The trial is now set for July 2025 as there are unresolved issues on both sides.
